First, a little background.

Whole Woman’s Health v. Jackson is a lawsuit that was filed by an abortion provider, a pro-choice activist organization, and the ACLU with the aim of preemptively preventing the enforcement of SB 8 (Texas’s anti-abortion law). WWH v Jackson has been in the courts for some time. SB 8 was enacted on May 19, and WWH v Jackson was filed in a federal district court shortly thereafter. In the event, the plaintiffs failed in their effort to keep SB 8 from going into effect. It did so on Sept 1. …

McConnell is getting high marks for his speech, even from some Ds. He does deserve credit for torching Trump for his conduct. Even so, his main argument — that the Senate properly acquitted because only a sitting officer can be convicted — is disgraceful. 1/22

Watch: McConnell’s full remarks following Senate vote to acquit TrumpDuring a lengthy and powerful speech on the Senate floor, Mitch McConnell blamed former President Trump for “ a growing crescendo of false statements, conspiracy theories and reckless hyperbole.”https://tinyurl.com/yxzedgcr

McConnell’s argument is based on the entirely erroneous and unsubstantiated allegation that the Constitution considers only two…

Trump’s approval rating is now around 34%, and 63% of voters disapprove of him. 80% of Republicans approve of Trump’s performance, but only 4% of Democrats and 30% of independents do. And only 40% of Republicans want him to run again in 2024. (Compilation from the latest Gallup and Politico/Morning Consult polls.)

But the 80% figure is significant, and these MAGA voters are not going away. It is hard to see this as anything but an insoluble problem for the GQP. 1/6

The GQP leadership might be thinking that the voting intensity of the MAGA right is greater than the…

Section 230 of the Communications Decency Act provides in part that “no provider or user of an interactive computer service shall be treated as the publisher or speaker of any information provided by another information content provider.” 1/11

Congressional Democrats are now proposing to significantly amend Section 230.

It is easy to see why Sen. Warner’s proposed amendment is an existential threat to two major destructive forces in American cultural and political life: Facebook and MAGA. tinyurl.com/y57y9b4v 2/11

Bill unveiled to reduce Section 230 protections for social media companiesThe new legislation, introduced Friday, could lead to more lawsuits against Facebook…

It is a fundamental mistake to confuse congressional impeachment with a civil trial. The two have quite different purposes, and very different rules apply to them. 1/15

For one thing (not the only thing), the Constitution does not authorize Congress to impose the same civil penalties that civil courts can impose. 2/15

Trump — who was a private person as well as president on or before January 6 — might well be tried in criminal court now *as a private person* for his actions *as a private person* on or before January 6, 3/15

January 6 wasn’t just an attempted coup — it was also an incitement to insurrection and revolution. That’s an important difference.

What the Senate, the FBI, the Capitol Hill Police, and law enforcement need to know in particular about Sen. Ted Cruz’s role in the insurrection on January 6

As I have pointed out in a previous posting, many of the rioters found to their dismay and bewilderment that there was no plan, at least that they could discern, for the mob to carry out that day. 1/63

The events on January 6 and Trump’s impeachmentWhat did the mob intend…

There were at least two insurrectionist plans that day.

As I’ve written previously, one of the plans was simply to either take Pence hostage or to assassinate him. 1/28

That was the more extreme plot, and it is an interesting question whether and to what extent Trump, Giuliani, some WH aides, and some nationalist insurrection members of Congress knew of the plan and…

What did the mob intend to do when it got to the Capitol on January 6? What did Trump expect it to do? And does any of this even really matter for Trump’s impeachment?

GQ has interviewed Ariel Kovler, who has studied pro-Trump insurrectionist social media platforms since 2015. Kovler saw January 6 coming a long time ago.

His interview is a must read. 1/30

The Man Who Saw Yesterday’s Coup Attempt Coming Is Only Surprised It Wasn’t Much Worse“It was not the army I expected it to be.” https://tinyurl.com/yykxmxur

According to Kovler, the mob that stormed the Capitol was…

Rubio: “The people who stormed the U.S. Capitol were ‘lied to by politicians who were telling them that the vice president had the power to change the election results.’” 1/15

Rubio waited until after Capitol attack to say politicians lied to Trump rioters

But the lie isn’t the crucial thing. (Trump’s defenders and enablers can always bring out the old chestnut that “all politicians lie.”) 2/15

The essential point is that the lie was used as the basis of the attempt by Trump and a majority of House Republicans and a minority of Senate Republicans to unlawfully overturn the 2020…
